Terms of Service (AGB) – Epic Comedy Berlin UG (haftungsbeschränkt)

  1. Scope
    These Terms govern bookings and services of Epic Comedy Berlin UG (haftungsbeschränkt), Anton-Saefkow-Straße 52, 10407 Berlin (“ECB”, “we”). They apply to B2C private customers and B2B clients (companies, agencies). Deviating terms require written consent.
  2. Services
    Live comedy shows, hosting, curated line-ups, interactive formats, and optional audio/video capture. The exact scope, date, location, language (English), and runtime are set in our offer/confirmation (“Agreement”).
  3. Booking process & contract
    A contract is formed when we confirm your written request (email sufficient) or when tickets are purchased via our ticketing partners (e.g., Humanitix). For third-party ticketing, their terms also apply.
  4. Prices & payment
    B2B: Fees per Agreement; plus VAT if applicable. 50% deposit on confirmation, balance due 5 business days before the event unless stated otherwise. Bank transfer (preferred). B2C ticket prices are shown gross on the ticketing page; payment via the ticketing provider.
  5. Client duties (B2B)
    Client ensures venue access, compliance with house rules and safety, and provides a suitable performance area. Sound (PA/mics) can be provided on request and for a fee by ECB; otherwise the client provides adequate AV as per our rider. Client obtains any venue or permit approvals.
  6. Content boundaries
    We perform English-language comedy. Tone and boundaries are agreed in advance. ECB may adapt material on site for safety, inclusion, or legal compliance.
  7. Filming & rights
    Filming/recording is optional and requires prior written agreement on rights/usage. Unless agreed, commercial recording or live-streaming by the client is not permitted.
  8. Changes, cancellation, force majeure
  • Client cancellation (B2B): up to 30 days before event: 25% fee; 29–14 days: 50%; 13–7 days: 75%; <7 days: 100%. You may propose a new date; rescheduling fees may apply.
  • ECB cancellation: If an artist is ill or unavailable, we will provide an equivalent replacement or offer a new date. If neither is possible, fees already paid will be refunded.
  • Force majeure: If performance is impossible due to events beyond either party’s control (e.g., government orders), both sides will try to reschedule in good faith. Refunds/rescheduling per statutory law and Agreement.
  1. Liability
    ECB is liable for intent and gross negligence; for simple negligence only for breach of material duties (Kardinalpflichten) and limited to foreseeable typical damage. Liability for injury to life, body, or health remains unaffected. No liability for third-party services (e.g., venue operations, ticketing providers).
  2. Youth protection & house rules
    Events in bars/clubs follow local law (Jugendschutz). Venue rules apply.
  3. Data protection
    We process personal data in line with our privacy policy.
  4. Governing law & venue
    German law applies. For merchants (Kaufleute), exclusive venue is Berlin. Consumers’ mandatory protections remain unaffected.
  5. Final provisions
    If a clause is invalid, the remainder stays effective. Changes must be in text form.
